Salient features of Intrastate Open Access in the State of Haryana

Open Access Regulation is an effective step towards private participation, harnessing of unutilized captive power and sale / purchase of power from CPPs & simultaneously encouraging IPPs to augment power generation.
|

|
The Section 38 & 39 (2)(d) of the Electricity Act, 2003 provides for non-discriminatory open access to the transmission system of a transmission utility.
|
| |
|
Section 42 (2) of the Electricity Act 2003,provides for introduction of open access in distribution.
|
| |
|
In terms of Section 178 of the Electricity Act, 2003, CERC notified open access regulation in January 2004. |

Notification on Intrastate Open Access by State Regulator |
| |
The Haryana Electricity Regulatory Commission, in terms of Section 181 of the Electricity Act, 2003, notified Open Access Regulation on 19 th May 2005. |

Provisions in Brief in HERC Notification |
|
Customers have been categorized in two categories as per HERC Regulation: |
|
a.
|
Long Term Intra-State Open Access Customer – Availing Open Access for a period of 5 years or more. |
|
b.
|
Short Term Intra-State Open Access Customer – Availing Open Access for a period less than 5 years. |
|
Allotment Priority |
|
As per HERC regulation, priority of the applications is to be decided in the following manner: |
|
a)
|
Distribution licensee |
|
b)
|
Other Long Term Open Access Customer |
|
c)
|
Existing Open Access Customers provided he applies for its renewal 30 days prior to the existing term.
|
|
d) |
New Customer |
|
e) |
Subject to above all cases on first come first serve basis. |
|
Period of Processing |
|

|
Decision to be communicated to short term customer within 30 days; and |

|
To long term customer within 60 days. |
|

|
In case system studies are to be conducted, the same shall be carried out after consent from the customer. The expenditure upto Rs.50,000/- is to be borne by customer.

|
Results of system study shall be made available within 90 days after receipt of request form customer.

Charges Payable |
|
Long Term & Short Term Customers shall be required to bear the following charges: |

Surcharge and the Additional surcharge on the Short Term Open Access Transactions waived off by Haryana during the summer months of 2006 and 2007. This waiver has been extended again from January 2008 to March 2011.

| Procedure to apply for Open Access |

The notified Nodal agency is State Transmission Utility. (Haryana Vidyut Prasaran Nigam), office of the Chief Engineer S.O. and Commercial. Phone no 0172-2560547, fax no. 0172-2560622.

Application on prescribed format is required to be submitted to Nodal agency with a copy to concerned Discom.
|
| |
•
|
Non-refundable application fee of Rs. 5000/- for Short Term Open Access & Rs.50000/- for Long Term Open Access is to be enclosed with the application, drawn in favour of Accounts Officer, HVPNL, payable at Panchkula.
|
| |
•
|
Separate applications shall be required to be submitted for long term and short term open access.
|

The current transmission charges as per HERC order on ARR for FY 2011 for Short Term Open Access Customers are 28 Paise / kWh. |

The current Wheeling charges for DISCOMs as per HERC Order applicable to DISCOMs are @40 Ps/Unit. |

UNSCHEDULED INTER-CHANGE CHARGES |
| |
•
|
DISCOMs have filed applications before HERC for notification of Unscheduled Inter-change charges but notification from HERC is awaited. |

|
CERC vide its notification effective from 01.04.2008 has notified intrastate UI Charges also for the States which have not notified UI rates. The notification specifies that “unless specified otherwise by the concerned State Commission, UI rate for intra-State shall be 105% (for over-drawals or under generation) and 95% (for under-drawals or over generation) of UI rate at the periphery of regional entity”. |

Metering Arrangements |
| |

Special Energy Meters (SEMs) Main as well as Check meters shall be required to be provided at inter-connection points as per provisions in Section 22 of the Regulation by the Utilities as specified therein.

|
DISCOMs / STU and SLDC shall make all necessary arrangements to download the recordings made by SEM at specified intervals.
